Kiwitron s.r.l. (hereinafter also referred to as “Kiwitron” only) respects privacy and commits to processing personal data with the utmost diligence and in full conformity with the applicable legislation, including, but not limited to EU Regulation 2016/679 (“GDPR”) and Italian Legislative Decree 196/2003 (Privacy Code), also in accordance with the last update of Italian Legislative Decree 101/2018.
This privacy notice is aimed at informing you, with the utmost transparency, about the ways personal data is being processed by Kiwitron within the context of its business, by the means of the “Contact us” and “Work with us” sections and, overall, the means of communication that are made available throughout the kiwitron.com website (hereinafter also referred to as “the Website” only) and/or social networks linked to Kiwitron, as well as data you can give through the subscription to our newsletter.
This policy does not relate to other websites, pages or online services which, in their turn, do not relate to Kiwitron even though they might be accessible through the Website.
It is of utmost importance to us to explain to you how we collect, use and store your personal data. Therefore, we invite you to carefully read this policy before forwarding any information and/or personal data to Kiwitron.
By “personal data” it is meant every information allowing to identify, although indirectly – e.g., through the cross-combination with other information – a person. For example, e-mail address, name and telephone number can be held as personal data.
The data controller is Kiwitron s.r.l., with registered offices in Sasso Marconi (BO), via Vizzano n. 44, e-mail: privacy@kiwitron.it.
While carrying out its activities, Kiwitron processes identifying and contact personal data, including: name, email address, telephone and fax number, tax information, name of the society you are referring to and position occupied within the same society.
The same data may be collected within the ordinary business activities of Kiwitron, through its commercial network, in occasion of events organized by Kiwitron and/or in which Kiwitron participates, as well as in after-sale service.
Such personal data is processed by Kiwitron even further to interactions between the user and the Website and/or social media profiles linked to Kiwitron have taken place, namely, by sending communications to the addresses indicated on the Website, by filling the “Contacts” form or by sending applications either through the “Work with us” section of the Website or the other recruitment channels used by Kiwitron, as well as by subscribing to the newsletter throughout the dedicated form.
Kiwitron may also process personal data originating from the mere browsing of the website. IT systems aimed at the functioning of this website collect some personal data whose transmission is implied in website browsing. Some of them may consist of: domain names of users’ computers, IP addresses, time of access to the Website, the method by which the server is invested with the request and other criteria concerning both the user’s operative system and platform of choice.
Lastly, Kiwitron may process data originating from the use of cookies, as in pieces of information saved through the browser during website browsing. Cookies encompass a series of data that are retained – depending on the type of cookies – either until the expiry of the browsing session or for a longer amount of time. While conducting its business, Kiwitron processes personal data to supply its products and services, reply to requests for information concerning said products (e.g., estimates, technical and/or commercial requests), eventually sent through the Website, to offer post-sale assistance, to serve recruitment purposes, and, more in general, to manage relations with its commercial partners and with other subjects with whom Kiwitron interacts while conducting its business (including its suppliers).
Kiwitron also processes personal data to provide its clients with information on products they have previously bought and/or similar products, as well as to update them on news about such products and/or their availability (“soft spam”).
Data related to browsing will only be processed to obtain statistics on the use of the Website and to ensure a solid browsing experience.
Only upon consent, Kiwitron uses the e-mail address used to subscribe to the newsletter service to send promotional communications relating to its business, its products and events organized by Kiwitron and/or in which Kiwitron takes part.
Moreover, Kiwitron may process personal data to comply with legal duties and/or to exercise its rights and, more generally, to defend its own prerogatives.
It is not compulsory to provide personal data for every processing purpose; however, refusal to do so may prevent us from satisfying your requests.
When conducting its business, Kiwitron processes personal data with the aim of establishing business relations (therefore, to execute pre-contractual measures), as well as executing contracts to which Kiwitron is a party, including those of supply of Kiwitron products and services (pursuant to Article 6, letter b), GDPR).
The same activities of processing are carried out also on a basis of legitimate interest to the execution and promotion of commercial undertakings, to an efficient management and organization of its business (also with regards to the activity of recruitment and selection of personnel), as well as to the protection of rights of Kiwitron in court and/or in front of the competent authorities (pursuant to Article 6, letter f), GDPR).
Upon your consent to the processing of such personal data, Kiwitron uses the e-mail address used to subscribe to the newsletter service for the promotional purposes listed above (as per Article 6, letter c), GDPR).
Further processing of all of your personal data can be carried out by Kiwitron to comply with legal duties (pursuant to Article 6, letter c), GDPR).
Kiwitron limits access to personal data to the highest extent possible, making it available to its authorized personnel who are entitled to access to it for the execution of specific tasks only. The Kiwitron team carries out activities of personal data processing according to the commands issued by Kiwitron and within their limits.
Personal data may be communicated to third parties collaborating with Kiwitron in the performance of its activity, such as service providers, consultants and attorneys assisting Kiwitron in the establishment of contractual obligations and, if necessary, the management of litigations and requests from the competent authorities, in addition to conforming to legal duties.
Kiwitron provides third parties only personal data that is necessary to perform the agreed tasks.
Depending on the cases, parties Kiwitron collaborates with to carry out its business process personal data as data processors, pursuant to the directions given by Kiwitron or, alternatively, as independent data controllers.
Kiwitron processes personal data both on paper and with the help of electronic means, within the limits of the purposes hereby listed and by taking measures aimed at preserving data confidentiality.
Since Kiwitron holds in great regard data protection and confidentiality, it does not perform any activity of disclosure or marketing of the personal data it processes; instead, it will take every measure that is required to update personal data and – if necessary – correct data that has already been collected.
To supply the newsletter service, Kiwitron makes use of the MailUp platform, provided by Growens s.p.a., which committed to taking every measure deemed as necessary in order to ensure that data processing activities are compliant with applicable dispositions concerning data protection, also in accordance with the transfer of personal data outside of the European Union, as set out in Article 45, GDPR. Kiwitron retains your personal data exclusively for the period of time that is necessary to the pursuit of the aims of each activity of processing as above indicated. At the end of this period, your data will be either cancelled or be anonymized.
Personal data processed in order to perform contractual duties – including the pre-contractual activity – is retained for the ten years subsequent to the end of said duties or, in the event that the pre-contractual phase does not lead the parties to enter a contract, for five years after the end of such phase.
Personal data processed for business accounting purposes are retained to the extent of time that is necessary to fulfil tax obligations and accounting.
Personal data processed for “soft spam” purposes are retained for 24 months subsequent to the purchase on the basis of which information is sent.
Personal data that candidates and/or job seekers send to Kiwitron, both by the “Work with us” form and the other channels used by Kiwitron for personnel research and recruitment purposes will be retained for a period of 12 months from the reception.
The processing required to send newsletters entails the use by Kiwitron of the email address provided for this purpose for a period of 24 months from the time of subscription to the service. After this period and without prejudice to a further expression of consent, your email address will be deleted from the list of newsletter recipients and no further promotional communications will be sent by Kiwitron.
In the case you want to receive a list of the processors involved in the processing of personal data carried out by Kiwitron (that is, third parties collaborating with Kiwitron in the performance of its business and conducting personal data processing activities on behalf of Kiwitron and according to the instructions given by Kiwitron), you may refer to Kiwitron at any time by the means of an e-mail to privacy@kiwitron.it.
You may use the same means of communication to exert your rights under the relevant legislation (as per Articles 15 to 22, GDPR), with specific regards to the right to:
Once your request has been received, Kiwitron will process it fairly and promptly, in order to facilitate the exercise of your rights, providing you with a steady response (and, in any case, within a month from the receipt of the request). Only in the event of complexity of such a request, the term may be delayed up to two months; in that case, Kiwitron will keep you updated on the current state of your request.
